After Taking the Stand, Swift Comes Out Victorious in Groping Trial

Taylor Swift is the top of our girlcrush list right now. This talented singer may live a very public life and we might think we know everything about her and her relationships but there is one aspect of her personal life that for quite some time she fought relatively quietly. That was until her day in court. Swift took the witness stand in the case against the DJ who groped he and told it like it was. She did not back down. She spoke for all of us; and she made sure she was heard. And heard she was. A jury returned a verdict after only four hours finding that back in 2013, Colorado radio DJ, David Mueller groped her.  In deposition testimony prior to trial here’s what Taylor said happened. While posing for a photo with Mueller, “he took his hand and put it up my dress and grabbed onto my ass cheek, and no matter how much I scooted over, it was still there. It was completely intentional. I’ve never been so sure of anything in my life.” At trial she was just as clear, even more so really.  One of our favorite Swift responses while on the stand was to the question as to why her skirt wasn’t ruffled in the front if she were groped, “Because my ass is located in the back of my body,” the singer responded.

Note that Mueller got himself in the position of fighting Swift in court. Swift did not report the incident to police (which, by the way, she could have–his alleged actions could have supported a criminal charge) but rather, promptly told her mother and her team about it who notified Mueller’s employer. No one from Swift’s side asked for Mueller to be fired. They simply reported the incident and allowed the radio station to handle it. Wisely, the station fired Mueller.  Not so wisely, Mueller sued Swift for slander in 2015, claiming he never touched her and suffered damages including the loss of his job as well as other professional opportunities as a result of her claims.

Swift did not stand by and allow Mueller to contradict her and filed a counterclaim for assault and battery. In May 2017, the court threw out Mueller’s claims of slander and the matter only went forward on intentional interference with a contract and tortious interference with prospective business relations (in addition to the counts in Swift’s counterclaim). Interestingly, after Swift testified her attorney moved that she be dismissed from Mueller’s suit altogether as Mueller had not presented sufficient evidence to show that Swift had interfered with anything. The judge agreed and Swift was dismissed as a defendant–only her mother and Bell, her radio manager remained. Mueller didn’t win against the remaining defendants either. In addition to finding that Mueller groped Swift the jury also found that neither Swift’s mother nor her radio manager did anything wrong–they had not tortuously interfered with anything regarding Mueller’s career. Bottom line: Mueller lost all around.

Swift only sued for $1.00 and that is what the jury awarded but after the verdict the ever-classy Swift acknowledged her privileged position in society and said, “I will be making donations in the near future to multiple organization that help sexual assault victims defend themselves.” Is there anyone cooler than Taylor Swift? We at PROOF don’t think so and want to add our thank you to the long list of thank yous she has been getting since taking up this fight. Thank you, Taylor you’re “Fearless!”

 

 

Celebrities Call for Gun Control Laws After the Tragedy in Las Vegas

News of the tragedy in Las Vegas on October 2nd, 2017 shocked the nation and made many of us ask the question, “How did this happen?” The shooter, Stephen Paddock, interrupted Jason Aldean’s set at the Route 91 Harvest Festival with rapid gunfire. The gunman had 47 firearms with him, including pistols, shotguns, and rifles. Some of those firearms were fitted with devices to turn them into automatic weapons. At one point, it is believed that he fired 280 rounds into the crowd in just 31 seconds from the 32nd floor of the Mandalay Bay Hotel into a crowd of nearly 22,000. The violence would cost 58 people their lives and leave 527 injured.

Along with thoughts and prayers, celebrities made statement after statement about gun control laws in the US.

Sophia Bush wrote in a series of tweets, “Dear Donald. F–k you for this. Truly. Sincerely, America.” She went on to say, “Last night’s violence was horrific and impossible to understand. Do not let our “leaders” make it easier for domestic terrorists to commit atrocities like this. Call them every day. All day. Demand they stop the silencer bill. Demand they act. Demand they DO SOMETHING. We owe it to our fellow citizens to stand up, speak up, & show up. Call.”

Mark Ruffalo tweeted, “This day sucks. It sucks to see this happen again and again. It sucks that these dear souls lost their lives to a machine that loves violence. It sucks knowing that nothing at all will be done to curb it.”

Elizabeth Banks weighed in, posing the questions, “At what point do we Americans say #enough? It would be wise to ban assault weapons, high-capacity magazines and silencers. None of which is excessive.”

Ariana Grande, who experienced tragedy herself when her concert in Manchester was bombed, wrote, “My heart is breaking for Las Vegas. We need love, unity, peace, gun control & for people to look at this & call this what it is = terrorism.”

Sheryl Crow wrote, “Oh no! How can this be happening? I am praying for the families and friends of those who were shot. Can we discuss the loss of rights of people going to a concert because of the lack of assault rifle regulations?”

Lady Gaga wrote, “This is terrorism plain and simple. Terror bares no race, gender or religion. Democrats & Republicans please unite now #guncontrol.” She continued, “Prayers are important but @SpeakerRyan @realDonaldTrump blood is on the hands of those who have power to legislate. #GunControl act quickly” as well as “Anyone who does not fight for gun legislation to ban assault weapons cannot claim to be pro-life.”

Billy Eichner expressed disbelief at the entire situation: “Congress did nothing after Sandy Hook. NOTHING. Think about how INSANE that is. We’re calling Congress about everything else, why not this??” He went on to use more colorful language, “Gun control now. Enough already. Grow the f-ck up. The average person doesn’t need a f-cking machine gun. Enough already. Enough. Enough.”

Michael Ian Black wrote, “The NRA is a terrorist organization. There’s no other way to say it.”

Andy Cohen had a simple response, “How about we ban machine guns?”

Even Hillary Clinton weighed in: “Imagine the deaths if the shooter had a silencer, which the NRA wants to make easier to get. Our grief isn’t enough. We can and must put politics aside, stand up to the NRA, and work together to try to stop this from happening again.”

The NRA and others against gun control use the 2nd Amendment, the Right to Bear Arms, as their sword. Certainly, our forefathers did not draft the 2nd Amendment with the intent to allow people like Paddock to build a personal arsenal–police recovered 23 firearms at Mandalay Bay and 19 firearms from Paddock’s home–so that a crime of epic proportions resulting in massive loss of life and a lifetime of fear for thousands of others could result.

Our deepest condolences are with the victims and the families affected by this awful attack.

 

 

Abby Lee Miller Going to Prison for Fraud

Former “Dance Moms” star Abby Lee Miller pleaded guilty in June 2016 to bankruptcy fraud and bringing foreign currency into the country illegally. On May 9, 2017 she was sentenced to one year and one day in jail and ordered to pay a fine of $40,000. Not bad considering if she were convicted of the initial charges she could have served five years in prison.

Her crimes were kind of interesting in that prosecutors charged her with hiding $775,000 in income when she filed for bankruptcy, and with having her friends bring her Australian currency into the United States hidden in plastic bags (We know what you’re thinking, Abby Lee Miller has friends???)

Her attorneys argued at her sentencing that she shouldn’t receive jail time because she allegedly paid back all of the money she owed after the fraud was discovered. They further argued that Miller wasn’t a criminal, just an inexperienced businesswoman.

That didn’t sway the judge, who told Miller that she had “lost her moral compass.” While we agree with the court in not buying her excuse, we can’t say that Miller lost her moral compass at the time the crime was committed. Have you seen Dance Moms and the way that she would treat those kids (and their moms!)? At PROOF, we think Miller lost her moral compass way before she broke the law. Also, some of the dance moms attended the sentencing but allegedly not to support their children’s’ long time teacher.

In any event, in typical Abby Lee Miller style, the former reality tv star appears to be making the best of things, telling “Good Morning America” after the sentencing, “I’m just going to pretend I’m shooting a movie and we’re on set and I’m there for 10 months. That’s the way it’s going to be.”

Well, maybe with all that time she will find the moral compass she lost all those years ago and she won’t be just another reality tv casualty.

Shia LaBeouf’s Racist Rant Goes Viral as the Actor is Arrested Again

It’s getting harder and harder for us at PROOF to be Shia LaBeouf fans — we’ve stood behind him for a very long time now but his latest racist rant against two police officers is making it very, very difficult.

LaBeouf was arrested on Saturday, July 8, 2017 in Savannah, Georgia, where he’s currently filming “The Peanut Butter Falcon,” with Dakota Johnson and Bruce Dern.  He was booked on charges of disorderly conduct, obstruction and public drunkenness after he reportedly approached someone to ask for a cigarette in the early morning hours, and became aggressive when he was told no, at which point he began shouting profanities at both passers by and police. The police statement reveals “When the officer attempted to place LaBeouf under arrest, LaBeouf ran to a nearby hotel. LaBeouf was arrested in the hotel lobby, where his disorderly behavior continued.”

What makes this situation so indefensible is what happened after the arrest. In a video captured on a body camera during his ride in a squad car and at the station, LaBeouf is heard telling his female arresting officer, “If I had my gun I’ll blow your s—t up. You’re a b—h, though.” He continues his racist, sexist tirade making threats against the officer, insulting her family and threatening to sue her, saying “I got more millionaire lawyers than you know what to do with, you stupid b—h.” The 31-year-old actor was released around 11 a.m. that same day from the Chatham County Detention Center after posting a $7,000 bond.

This is the sixth arrest for the actor, and latest in a long line of alcohol-related incidents. LaBeouf was ordered to receive alcohol abuse treatment after a 2014 disorderly conduct charge in a Broadway theater. He received treatment in 2016. “He is voluntarily receiving treatment for alcohol addiction. He understands that these recent actions are a symptom of a larger health problem and he has taken the first of many necessary steps towards recovery,” his rep said in a statement. LaBeouf himself has discussed his demons in the past, saying “Why am I an alcoholic? I haven’t a damn clue! What is life about? I don’t know. What I do know is, I screw up.”

La Beouf returned to work on Monday, just two days after the arrest. He also took to twitter to apologize, writing “I am deeply ashamed of my behavior and make no excuses for it” as well as addressing his very serious problem with addiction. Shia, please get help (again-no shame in that!), we really want to remain fans.

Can You Put a Price on Fame? These 3 Celeb Incidents Show the Cost

Many of us think we’d trade pretty much anything for fame and the money and power that goes along with it. This is especially true for those in the creative world: starving artists waiting and working so hard for that big break. But once it comes, life will never be the same, and not necessarily for the better.  Let’s look at the three events of Fall 2016 that, but for fame, would likely have never befallen these celebs.

Kim Kardashian

It may be a little unpopular to admit or even to call her a creative but I’m a Kim K fan. To be fair, I don’t watch Keeping Up With The Kardashians (well, not on purpose anyway), I don’t follow her on Instagram, and I don’t buy any of the products she promotes but I’ve always had a soft spot for her. Why? Because Kim pretty much stays out of trouble. You never hear about her using illegal drugs, drinking excessively, or having dramatic public breakdown (her husband maybe, but not her). She rarely speaks derogatorily about anyone (she may have skirted the line with Taylor Swift, but I blame most of that on Kanye) and, most importantly, she’s pretty darn self-aware. Who can forget her Instagram post, “#NotBadForAGirlWithNoTalent, on the day her Forbes magazine cover came out with the headline “She Made 45 million From One Game.” But it is precisely her fame and the wealth that comes with it that made her the target of a violent crime in Paris on October 3, 2016. Think about Kim that night, but try to wipe from your consciousness her fame, the carefully curated social media image. She was just a woman, a mother, sleeping soundly in a supposedly safe place, woken up by masked men, pulled from her bed and tied up, her mouth taped.  She thought she was going to be raped. Really think about that. What if this were happening to your mother, your daughter? And those that say she asked for it by flaunting her lifestyle? In my opinion Kim no more asked to be the target of a violent robbery by posting images of her in her jewels than a rape victim asked to be raped because she dressed seductively. What a backward, victim-blaming thought. What happened to Kim was scary, life altering, and criminal and it would not likely have happened if Kim was just the daughter of a lawyer.  Since the attack, Kim has basically withdrawn from social media, changed the entire way she has lives, her husband has undergone a serious mental breakdown. Her life, since that terrible night in Paris, has not, nor will it ever be the same. And despite video footage, the case seems to be stalled—there have been no arrests, no recent comment from Paris police. All Kim can do is wait. Wait and see if the perpetrators are every brought to justice.

Miranda Kerr

Shaun Anthony Haywood has been arrested and charged with attempted murder, aggravated mayhem and assault with a deadly weapon by the LA County DA’s Office. He stands accused of entering Miranda Kerr’s Malibu property and slashing a guard’s face with a knife; the guard shot Haywood during the confrontation. Fortunately, Miranda nor her young son was home at the time. I live only a few miles from there and I can tell you this type of incident is very rare. Malibu, contrary to what many people think, is a sleepy, beach town, where surfers outnumber celebs and there’s barely a car on the road after 10:00pm (except maybe in the Nobu parking lot).  Again, lucky that Miranda wasn’t home and luckier still that she had security that prevented her home from being invaded. But as with Kim, think about this—is this how you want to live? Needing round-the-clock security? Not feeling safe in your own home? In a magazine article published just two months prior to the attempted invasion, Miranda was quoted as saying about her home that it was a “sacred space,” a calm refuge from her hectic schedule filled with reminders of a happy childhood.  Apparently, Miranda has said she doesn’t want to return there.  That’s a shame.

Adam Levine

To me one of the saddest celeb stories of Fall 2016 was the allegation that Adam Levine, the tattooed lead singer of Maroon 5, and favorite coach on The Voice, had abused his infant child and his wife, Behati Prinsloo. The report was made anonymously to the LA Police Department.  And, because they are mandated to investigate every report of child abuse, the police had no choice but to do so. Imagine Adam Levine, proud new father, having to answer questions about how he interacts with his infant daughter and wife. Thankfully, the investigation was swift and the case was closed just as swiftly as no evidence of abuse or domestic violence was found. But this experience will likely haunt Adam for a very long time. As the report was baseless, does he have any recourse? Can he sue the anonymous tipster? Would the DA charge the tipster criminally for false reporting of a crime? In California, people who are not legally mandated to report child abuse allegations (like teachers or doctors) can do so anonymously.  Mandatory reporters are immune from civil or criminal liability and so are others, like the anonymous Levine tipster, unless it can be proven that a false report was made and the person knew that the report was false or was made with reckless disregard of the truth or falsity of the report.  So, from what we know, it seems that this tipster falls into that category. But is it really in Adam’s best interest to pursue a civil claim or seek to have the tipster prosecuted? Probably not. The best choice for him is to let the whole thing go way quietly.  And as with Kim and Miranda, but for his fame in all likelihood he would never have had to endure this awful experience.

So, the next time you feel pangs of jealousy watching a celeb on the red carpet, dressed in designer clothes, bright lights flashing or look at your Instagram followers and wish you could count yours in the millions (or the thousands even!), remember, there is a price for fame. Sometimes that price might just be too high.

Chris Brown Facing Legal Problems…Again

Chris Brown has more legal problems.  Two TROs (temporary restraining order) were issued against him in February 2017. His ex girlfriend, model, Karrueche Tran got one and now, one of Tran’s closest friends, Joseph Ryan LaCor, has one against him too.

It has been a wild 2017 already for the singer. It very clearly seems he still does not have control over his anger issues. On New Year’s, Brown apparently got into a violent fight with rapper Soulja Boy over Tran.  Then on February 17, 2017, Tran, who for years was Brown’s on again, off again girlfriend finally stood up for herself and sought protection for herself-she sought a restraining order against Brown.  In court documents she filed she alleged that Brown punched her in the stomach and pushed her down the stairs several years ago but that she did not call the police or report the incident (Tran, you are way too good to endure this type of relationship–all women, all humans are.) and that recently Brown has been sending her threatening texts. In the court documents, she included the following: “He told a few people that he was going to kill me. He said if no one else can have me, he’s gonna ‘take me out.” Due to his violent history, especially violence against women, a Chris Brown threat should not be ignored. And the LA court did not ignore the. They granted the request and now Chris Brown must stay away from Karrueche Tran or risk arrest, among other things.

So, how does LaCor fit into this story? Well, apparently Brown can’t leave well enough alone as it relates to Tran and has allegedly threatened to shoot Tran’s bestie, LaCor leaving LaCor with no choice but to seek the court’s protection as well.

In documents LaCor filed, it stated that Chris said about Tran and LaCor “no matter where we go, he will find us and shoot the place up.” LaCor also spoke of past conduct by Brown.  “Chris Brown has threatened me and run up on me for not allowing him to bully Karrueche Tran in my presence. More recently, making threats to her saying that he will beat anyone that is friends with her.”  

LaCor’s allegations are specific and also include details of a harrowing night hanging out with Tran at a 2017 Super Bowl party; Brown was also there. LaCor said that he was at the party for two hours when two men confronted him and told him to leave or he was, “going to have problems.” He said he decided to leave and that’s when, “Chris Brown ran up to me, got in my face, saying, ‘It’s 2017, Ima f–k you up every time I see you. So you better get the f–k out of here before I lay your ass out.””

LaCor also claims that Brown yelled at another friend of LaCor’s and threw a drink in her face.  After that, smart move by LaCor–he left the party. Given all this information, the TRO was issued and now Brown must stay away from LaCor as well. Quite a collection Brown is building.

Brown has allegedly been diagnosed with bipolar disorder but too bad for him that is not a legal excuse to threaten people or assault them. With all this recent unacceptable, illegal, scary behavior, you’d think that Brown doesn’t know what is at stake.  But after all his run-ins with the law, especially the domestic violence occurrence with Rihanna, he most certainly does.  No excuse, Brown. Get help.

A$AP Rocky’s Home Robbed, Almost $1.5M in Property Taken

 

Rapper A$AP Rocky was victimized to the tune of approximately $1.5 million on May 16, 2017-his Los Angeles home was robbed.

Rocky was not around as three armed male suspects allegedly stole more than $1.5 million worth of jewelry and other property. The suspects also attempted to steal a safe, but were not successful. Pretty scary though as a female relative was home, was the one who opened the door when the thieves knocked. Allegedly they held a gun to her and made them show her where the goods were. Thankfully,  she was not physically injured. We can imagine she was certainly emotionally injured.

As the dollar symbol in his name might suggest, the rapper is not one to hide his wealth. frequently posting photos of high-ticket items on social media. And Rocky, police keep warning celebs to stop flaunting their wealth (as well as detailing their whereabouts) so as to avoid being targeted. Certainly neither you nor your family member who endured the crime do not deserve this, but maybe it’s time to heed the LAPD’s advice.

One person AS$P might be turning to in the wake of the crime is Kendall Jenner. The two have been rumored to be seeing each other for months, and she’s particularly well-suited to sympathize, after being robbed in March of $200k in property. Her sister Kim Kardashian was also victimized in a widely publicized Paris robbery last fall, in which a whopping $10 million in property was taken.

Mueller Cannot Pursue Slander Claims Against Taylor Swift

A DJ who was accused by Taylor Swift of groping her against her will will not be able to pursue slander claims against the Grammy-winning songwriter.

Swift accused DJ David Mueller of reaching under her skirt and touching her inappropriately during a meet and greet in 2013. She reported it to his superiors at radio station KYGO, and he was later fired. Mueller sued the singer accusing her of costing him his job and damaging his reputation, and also said she was slandering him by reporting the alleged incident to the radio station that employed him (Law lesson: the fact that he reported it to job isn’t what makes it  slander. As soon as someone announces a falsehood about someone to someone else and there is damage to reputation, the slander claim is triggered).

Swift turned around and counter-sued Mueller, and in true Swift style (and one of the reasons we at PROOF love her) says she’ll donate any funds she recovers to “charitable organizations dedicated to protecting women from similar acts of sexual assault and personal disregard.”

In May 2017,  judge threw out Mueller’s slander claim saying, “There would appear to be nothing improper about Swift — or any other person — making an honest report to an entity with which she does business that one of its employees assaulted or harassed her.”

Meanwhile, Mueller has also been accused by Swift’s team of destroying evidence related to the case. He allegedly taped a conversation pertaining to an investigation into the incident, but only preserved a few key snippets.

The case is due back in court later this summer.

It’s Back to Mexico for Bachelor in Paradise Contestants

Bachelor in Paradise Update:  On 6.20.17 Warner Bros announced that along with outside counsel they have reviewed the footage of the alleged sexual misconduct involving Corinne Olympios and DeMario Jackson and have concluded there in fact was no such misconduct. Contestants will be heading back to Mexico and filming will resume. So far no word if Corinne and DeMario will be joining them. Corinne’s legal team has announced they are conducting their own investigation and we at PROOF would not be surprised to see DeMario seriously considers filing a defamation claim stemming from this incident. Two issues with that: 1: What are his damages (he already quit his job before filming even started despite reports that he lost his job as a result of the incident)?, and 2: If DeMario pursues a case, does Corinne have the money to pay a judgement or settlement?

Just how guilty is our guilty pleasure? This week might be a turning point for reality TV production now that Bachelor In Paradise star Corinne Olympios has made a statement about allegations of misconduct on the set of the show, which was being filmed in Sayulita, Mexico (which, by the way is a cute little surf town for those of you who don’t know). An anonymous crew member originally reported that an alleged sexual assault took place while Olympios, who was inebriated and unable to consent, was filming a scene with one of her co-stars, DeMario Jackson.

In her statement, Olympios wrote:

“I am victim and have spent the last week trying to make sense of what happened on June 4. Although I have little memory of that night, something bad obviously took place, which I understand is why production on the show has now been suspended and a producer on the show has filed a complaint against the production. As a woman, this is my worst nightmare and it has now become my reality. As I pursue the details and facts surrounding that night and the immediate days after, I have retained a group of professionals to ensure that what happened on June 4 comes to light and I can continue my life, including hiring an attorney to obtain justice and seeking therapy to begin dealing with the physical and emotional trauma stemming from that evening.”

Though she has not yet filed suit against Warner Bros. her co-star Jackson, or any other entities or individuals involved in the show, Olympios has hired famed Hollywood attorney Marty Singer to represent her. Singer has represented many celebrities including Charlie Sheen, Scarlett Johansson, and, until 2015, Bill Cosby. Before these allegations arose, Olympios had been represented by Melanie Cook. Cook reportedly referred Olympios to Singer whose reputation as a legal pitbull is second to none in Hollywood. In terms of lawsuits, Singer is well known to  Warner Bros. It was a case against them that Charlie Sheen hired Singer for when he had his Two and Half Men “situation.” Sheen sought damages of $100 million from Warner Bros. for their missteps; the case ultimately settled for an undisclosed sum.

The hiring of Singer is a bold, proactive move by Olympios and we at PROOF are definitely feeling a civil suit is in Warner Bros. very near future, as well as anyone else involved in the production who allowed this encounter to occur and to continue for the cameras. While no one has seen footage from that night (yet), many questions remain: Who bears financial responsibility for the incident? Did anyone speak up when it was occurring? Who monitors the alcohol intake of the contestants? Were any other intoxicants or drugs on set? Might DeMario face criminal charges in Mexico? Has he been questioned by Mexican police yet? If there is a lawsuit, will Warner Bros. be facing punitive damages? Was their behavior, and others who continued the filming of this act reckless in the eyes of the law?

Certainly Olympios and Jackson signed extensive and restrictive contracts in order to be on the show but Warner Bros. cannot contract away legal responsibility for everything–they do still have a duty and cannot engage in or promote reckless, non law abiding behavior.

The timing of this incident, right in the midst of the Bill Cosby trial jury deliberations is interesting, is it not? It all comes down to consent and the ability or inability to give it.

Mel B Gets Restraining Order Against Husband Stephen Belafonte

In a shock to those not close to her, former Spice Girl Melanie Brown, aka Mel B, sought a restraining order against her husband, Stephen Belafonte. (In March 2017, the pop star filed for divorce from him.) In support of the request Mel B alleged that she has suffered years of physical and sexual abuse at Belafonte’s hands during their 10-year marriage. The judge granted the order as to Mel B and also ordered Belafonte to stay away from the children and to immediately leave the couple’s home in the Hollywood Hills.

The America’s Got Talent judge says that the physical abuse began soon after they were married in 2007 and right around the “Dancing With The Stars” finale in November 2007 (Mel B lost); and it has continued since then. The singer claims she tried to leave Belafonte multiple times but he told her that he would destroy her if she left. Brown has said, “I desperately wanted to leave the relationship and tried to do so during our first year of marriage and every year thereafter. When I threatened to leave, [he] informed me he has videos of our sex life and other private moments.” She continued, “[He] would threaten that if I left, he would release the videos to the tabloids. I have lived the past decade in fear that [he] would release intimate videos of me that would embarrass me and damage my reputation and my career.”  

Brown also alleges, “[He] often times demanded that I participate in sexual intercourse with him and random women that he brought back to our hotel rooms. If I objected to participating, he would threaten to release compromising videos of me. He would often times surreptitiously videotape these encounters, and, if I discovered the recordings, would beg him to delete them.”

She went on in the docs, “Later, I would come to realize that [his] beatings and abuse would coincide with my career success,” she claims. “When something good would happen to me, he would beat me down to let me know that he was in charge.”

In July 2012, Brown claims Belafonte punched her after he accused her of flirting with Usher on the “X Factor.”  She also alleges that he punched her in the face in Prague, one day after the Spice Girls reunion at the London Olympics.

In court docs, Brown also alleges that Belafonte got their nanny pregnant and that he eventually demanded her to get an abortion.

Sadly, we speak of domestic violence frequently here on PROOF and we will continue to do so as an act of solidarity and support for the victims and as a way to educate our readers. The truth is, it is scary to be in an abusive relationship and as the Mel B situation shows, it is scary to try to get out of it.  In fact, when she requested the temporary restraining order, Brown said she feared for her life and that of her children’s lives. She wrote, “I am in fear of my safety and I am in fear of being irreparably harmed as a result of [Belafonte’s] threats. I fear [he] will carry out his threats against me which will collaterally harm the children.” The former couple has one daughter together, a 5-year-old named Madison, whom she is seeking full custody of in their divorce. Brown also has two other daughters from previous relationships — Angel (her daughter with Eddie Murphy) and Phoenix.

Belafonte has denied the abuse. His lawyers issued the following public statement: “What matters most to Mr. Belafonte is the safety and well-being of his daughters and step-daughters. It’s a shame that Ms. Brown elected not to proceed in a respectful and amicable fashion in this very private matter. In due course, Mr. Belafonte will be filing his response to the outrageous and unfounded allegations made by Ms. Brown, which allegations he vehemently denies.”

So, the response Belafonte’s lawyers will file will clearly be to deny the claims. Rest assured PROOF will diligently monitor this case. But with the alleged frequency of the abuse and the public life these two lived there is very likely going to be a greal deal of evidence uncovered–people who worked with and saw Mel B’s injuries are already coming out (thank you, Sharon Osbourne). And that’s what we like best here–PROOF. The more proof. We do wonder what Belafonte has to say about those pictures of Mel B’s bruised face. She’s just clumsy?

New Lawsuit Alleges That Disastrous Fyre Festival Was Nothing More Than ‘Get-Rich-Quick Scam’

Last week, social media exploded with shocking photos of the doomed luxury music festival in the Bahamas known as the Fyre Festival. Organizers, rapper Ja Rule and businessman Billy McFarland, had promised a luxury festival with A-list bands like Blink 182 and Major Lazer, gourmet food, and cush accommodations, and ticket holders had paid between 1,200 and $100,000 apiece to attend.

But when attendees began arriving April 27, all they found was a gravelly field, wind-and-rain-battered FEMA-like tents and bread and cheese for dinner. By Friday morning, the festival had been canceled — and the festival goers found themselves with few options to get home quickly. Organizers had encouraged them to leave their cash at home, and use pre-loaded festival wristbands instead, so, according to the lawsuit, many had no way to get a taxi to the airport.

So how did everything go so very wrong? According to a $100 million class action lawsuit filed by celeb lawyer Mark Geragos on behalf of attendee Daniel Jung, the festival organizers, who began promoting the festival back in December 2016, failed to deliver on even the most basic of their promises, and left the attendees in a life-or-death situation.

The suit alleges, “Defendants intended to fleece attendees for hundreds of millions of dollars by inducing them to fly to a remote island without food, shelter or water — and without regard to what might happen to them after that.”

The suit claims that the atmosphere on the island was less like Coachella and more like The Hunger Games, or Lord of the Flies, and goes as far as to allege that enticing the attendees to the island without basic services and no easy way to leave was “tantamount to false imprisonment.”

Festival organizers blamed inexperience. “We were overwhelmed and just didn’t have the foresight to solve all these problems,” McFarland has reportedly said. “The reality is, we weren’t experienced enough to keep up.”

But that explanation is just not good enough, according to the lawsuit. “This outrageous failure to prepare, coupled with Defendants’ deliberate falsehoods in promoting the island ‘experience,’ demonstrates that the Fyre Festival was nothing more than a get-rich-quick scam from the very beginning.”
Ja Rule strongly denied that allegation, telling Rolling Stone, “My partners and I wanted this to be an amazing event, it was NOT A SCAM as everyone is reporting. I don’t know how everything went so [wrong] but I’m working to make it right by making sure everyone is refunded.”

Refunds are allegedly in the works, and perhaps shockingly, the festival organizers say they’re moving forward with plans to hold the festival in 2018 in a U.S. location.

Shia LaBeouf to Kristin Chenoweth: Three Times Actors Suffered Intense Head Injuries on Set

Firefighters, police officers, service people headed to war — everyone knows these are dangerous jobs. But would you add actor to that list? You might if you considered some of the gnarly injuries actors and actresses have suffered on set over the years.

Shia LaBeouf ended up with gashes to the head and finger on the set of “American Honey” in 2015. Apparently a late-night scene called for LaBeouf to put his head through a plate glass window, but the stunt went wrong and he ended up in the hospital and needed stitches.

Meanwhile, actor Dominic Purcell was injured last summer on the set of FOX’s “Prison Break” reboot in Morocco in a pretty disturbing way — an iron bar fell on his head during an on-set explosion. The actor posted the below pic to Instagram, illustrating the extent of his injuries.


“I was running into a prison, and this explosion just occurred. I hit the ground, and there was blood just pouring onto the ground,” he said of the terrifying experience.

The accident left him with a broken nose and extensive, still-visible scars on his scalp. In describing the incident further, he said, “It was a really surreal feeling. Like, ‘Really? This is how it’s gonna end? I’m gonna die in Morocco?’”  Seems as if he did maintain a sense of humor though because on Instagram that posted that he got a free nose job out of the deal, and mused, “Pays to have a thick skull when an iron bar falls on your #head!!”

But the reality is on-set injuries are no joke and as Adam Rosen, a leading injury lawyer explains,

“The law surrounding on-the-job injuries applies to the entertainment industry and athletes in the same way it applies to other industries. Any type of employee — whether a mechanic, electrician, or even an actor — may have a claim for damages if injured while working. The key is for the injured employees to understand their rights as soon as possible after the incident.”  We certainly hope Kristin Chenoweth understood her rights because back in 2012 she had to quit her job on CBS’ hit legal drama “The Good Wife” when lighting equipment fell on her head, knocking her out cold and leaving her with a 5-inch skull fracture, 3 cracked teeth, and rib and hip injuries.

One minute she was filming the series — and the next she found herself on a gurney in a New York City emergency department, missing a shoe and an earring– and afraid. Most disturbing to Chenoweth was she said she couldn’t really form a sentence after it happened.

And things didn’t get better quickly. In 2014, a full two years after the accident, though her health was improving she was still going to physical therapy.

Luckily, almost five years later, it looks like Chenoweth hasn’t let the accident sideline her. She recently landed a role in the CBS pilot ‘Perfect Citizen’ and is touring this spring to support her 2016 album, “The Art of Elegance.”

So though most would love to believe that working on a set is glamorous all the time, the truth is most of the time it’s just like any job–there are risks and challenges.

Charges Dropped Against Shia LaBeouf in Assault and Harassment Case

Shia LaBeouf, a PROOF favorite, got some legal good news. Charges have been dismissed against the activist actor stemming from his January arrest in New York City that resulted from an alleged fight with a protester at his anti-Trump live stream protest/performance piece, “He Will Not Divide Us.”

As we previously reported, in January, LaBeouf was charged with misdemeanor assault and a harassment violation after that alleged fight.  Apparently, the actor got into a verbal fight in front of the Museum of the Moving Image, the site where the performance piece was streaming and the victim accused LaBeouf of scratching his face when he pulled his scarf. The alleged victim did not seek medical attention. LaBeouf was released a few hours after the arrest. He was given a DAT–a desk appearance ticket–which mandated that he was to return to Queens County Criminal Court for arraignment.

The Queens District Attorney’s Office have now reviewed the facts and information and have decided not to prosecute.  A spokesperson with the Queens District Attorney’s Office has confirmed that and said the charges against LaBeouf have been dropped for insufficient evidence. (Here’s a little fun PROOF point: I was an Assistant District Attorney in Queens. It’s my favorite New York borough– for law, not really for fun, that’s Manhattan!).

Shia LaBeouf, Luke Turner, and Nastja Ronkko, the artists behind “He Will Not Divide Us” began the performance piece on inauguration day, January 20, 2017.  Interested parties were invited to say, “He will not divide us” into a camera outside the Museum of Moving Image. The “protesters” were encouraged to repeat the phrase as often and as many times as they wanted into the camera. The artists intended the project to last four years. With the divisiveness that surrounds President Trump, the message the artists had hoped to get across was a powerful one, a unifying one. But, the art installation was shut down by the museum on February 10, 2017 because it had become “unexpectedly volatile.”

The artists then moved the project to a theater in Albuquerque, New Mexico. Things were not much better there as it was soon shut down due to gun shots. On February 23, 2017,LaBeouf himself tweeted “We have taken the stream down after shots were reported in the area. The safety of everybody participating in our project is paramount.”

Since then the project moved to a gallery, Foundation for Art and Creative Technology (FACT) in Liverpool, England (not far from where Turner is from). The artists made a statement on FACTS’s website stating that that the project moved because “events have shown that America is simply not safe enough for this artwork to exist.” Unfortunately though, on March 23, 2017, the artists and FACT announced that police advised them to remove the installation due to dangerous, illegal trespassing.

Despite the intent of the artist to maintain “He Will Not Divide Us” as a peaceful, nonviolent art performance, the fact that it has been rocked at each location as well as the subject of much talk on hate and violence filled sites on the internet is not only sad but very scary.

Paps Will Doing Anything for a Photo. . . J. Lo and A. Rod Accident

On October 15, 2018, Jennifer Lopez and Alex Rodriguez were involved in a car accident with paparazzi. The couple were heading out of a Los Angeles restaurant after enjoying a dinner date when their driver hit one of the paps who was posted up to catch a glimpse and a money earning photo of the power couple.

The photographer was snapping away while the couple was in their car. When the driver of their car began to inch onto the street the pap and was hit by the Escalade. Though the contact seemed light (no one disputes he was “inching”) the photog fell to the ground. The driver, to his credit, immediately got out of the vehicle to check on the man, but allegedly said, “See what happens when you flash all the flashes? I can’t see where I’m going.”

The photographer who was hit is said to have filed a police report, but the truth is the driver is not totally in the wrong here. In California, it is against the law for pedestrians to purposefully block vehicles with their bodies. And, if it does happen, drivers can attempt to move forward.

While we get everyone needs to make a buck and we too use their photos, when they create dangerous situations–either for themselves or others that is not ok. Of course, the J.Lo A-Rod crash isn’t the first time something like this has happened. We recently wrote about Bieber’s incident with a pap (Is it us or does it seem as if it’s always happening to Bieber when he’s leaving church?). It was clearly an accident–Bieber stopped to help the 57-year-old man and fully cooperated with the police investigation at the scene. But you also may recall Lindsay Lohan crashing her car in 2005 after a paparazzi chase. There was also the time in 2013 when Nicole Kidman was literally run over by a photographer on a motorcycle. And, of course we’ve written about the most famous case of these types of cases, Princess Diana’s fatal car crash whose death is often attributed to a paparazzi chase. They seemed to do anything they could, anytime they could, anywhere they could to catch a snap of the royal.

The situation isn’t just dangerous for celebrities, it’s clearly dangerous for the photographers as well. Seems crazy to us that they’d put themselves in harm’s way just to get a good picture-even if it is the money. Our sources tell us the money isn’t even that good anymore because of social media and the fact that celebs release their own photos all the time now.

Usually the paparazzi and the celebrities they trail have a pretty symbiotic relationship, but that doesn’t mean it’s safe for either party. We can imagine well the stress involved with being followed and photographed everywhere you go but add in the risk of physical injury from a car accident and it just makes us shake our heads.
