Kanye, Gaga, Beiber: Who is Financially Responsible When an Artist Cancels a Tour?

When a music artist cancels a tour for medical reasons, as Lady Gaga had to do in 2013 after suffering a labral tear on her hip, the tour is usually insured and the artist would not be responsible for the losses incurred for the cancellation. It makes sense in cases such as hers — Gaga’s shows feature heavy dancing, the experience wouldn’t be nearly as good if she sang while lying in traction, right? (Actually, note to Gaga, you can use that idea, I don’t think it has been done yet.) Touring insurance protects everyone, including the artist, from suffering huge financial losses when the reason for the cancellation is beyond the artist’s control.

But what about when an artist cancels a tour just… because? Justin Bieber recently announced that he would be canceling the remaining 14 dates of his Purpose tour, with one source saying the Biebs was just “over it.” In that case, an artist may face penalties due to the massive financial losses incurred from ticket refunds, plus all costs for promotion, marketing and advertising.

Kanye West is currently in the middle of a lawsuit that, to some, might seem to straddle these situations. Back in November, 2016, West canceled the final 21 dates of his Saint Pablo tour in 2016 and the cost of ticket refunds alone were upwards of $24 million. Two days after he canceled the tour, he checked himself into a psychiatric facility after suffering a breakdown which his own doctor called “a debilitating medical condition” that prohibited him from performing, yet West’s insurer, Lloyd’s of London, has not paid any claims out to West’s company, Very Good Touring, Inc. West is suing Lloyd’s for breach of contract and breach of good faith and fair dealing for upwards of $10 million.

West’s suit accuses Lloyd’s of London of not providing “anything approaching a coherent explanation about why they have not paid, or any indication if they will ever pay or even make a coverage decision, implying that Kanye’s use of marijuana may provide them with a basis to deny the claim and retain the hundreds of thousands of dollars in insurance premiums.” West also claims in his suit that Lloyd’s sought an independent physician to examine West to verify the claims of his mental health, and despite the fact that their doctor agreed with West’s primary physician, they continued to deny the claims. The suit essentially alleges that Lloyd’s continues to find provisions that will allow them to stall or deny payment.

As we all know, West is known for his controversial behavior onstage (and, sometimes, off) and in fact, just days before he cancelled his tour, he had been making erratic statements to the press and performing abbreviated shows, all of which ultimately led him to seek help.  Who determines the cause of his behavior and whether or not he should have continued performing his tour are two issues this case is sure to address. Justin Bieber and Hailey Baldwin Tied the Knot But Allegedly No Prenup. Romantic?!

We were sure Bieber and Baldwin were already married but we didn’t come right out and say it because we didn’t have the PROOF. But we know many of feel a little duped by the duo. The couple and their families had been ultra-quiet (ok, not Alec Baldwin) about all the speculation that they officially tied the knot, with some even denying that they wed, but now we know the truth.

Justin and Hailey reportedly tied the knot last month on September 13th! It was a very small, low key event with the couple getting their marriage license and making it official all in the same day.

Here’s the thing that has some of us scratching our heads (and it’s not that the couple got engaged and married so quickly): apparently, there’s no prenup. Certainly, prenups are not very romantic and a pretty stressful thing to discuss going into what is supposed to be a lifelong commitment based on love (looking at you 50%+ divorce rate!), but they’re extremely important for parties who have lot at stake. That’s an understatement for Bieber who is worth a reported $250 million. Baldwin can for sure pay for her own life with her net of a few million but there is a vast disparity between these newlyweds’ pockets. There are rumors that the couple both reached out to lawyers on the day of their wedding, but the prenup wasn’t able to be drafted on such short notice. Uhh, we don’t think so. Lawyers could have done something and/or the couple could have waited if it were really important to them. Clearly, love, not money was on their minds that day.  There’s something pretty romantic (albeit not-so-smart) about that.

But here’s the truth, they can have whatever documents they wish drafted now or whenever regarding assets and liabilities–it’s a postnuptial agreement or a contract. We haven’t seen a power couple move to draft a postnuptial agreement since Kim Kardashian and Kanye West, but it’s an option and can be done at any time in myriad ways.

Certainly, Hailey and Justin aren’t the first couple to tie the knot without signing on the dotted line. Russell Brand and Katy Perry didn’t sign a prenup before their lavish wedding in India. That meant that Brand could’ve walked away with a portion of Perry’s then $55 million fortune (she’s worth a heck of a lot more now). Luckily for Katy their marriage ended amicably, each going their separate ways, her fortune intact. Brand even signed over their $6.5 million home to her.

Reese Witherspoon notoriously didn’t have a prenup with ex Ryan Phillippe when they divorced in 2006 and didn’t get one when she married Jim Toth in 2011. Chalk it up to bad juju, but it looks like Reese doesn’t like the idea of jinxing the wedding with a document that basically states that the marriage might fail.

But not all divorces are amicable as we all well know (good time for a plug for Reelz channel new show, Irreconcilable Differences in which Jill regularly appears, click here for more info). Just look at Madonna and Guy Richie, one of the most famous cases of celebrity divorce of all time. The mega star married Richie in 2000 without signing a prenup and was worth $500 million when they divorced eight years later. She ended up paying the director $92 million of her fortune to end the marriage.

Long story short, we love romance and happy endings but we recommend a prenup for any lovebirds with some cash. But if you’re like Bieber and Baldwin and just can’t wait then as soon as the love fog dissipates a tad, go see your lawyers and get a postnup!

Justin Bieber Did All of the Right Things After Hitting a Pap with His Car, But Will He Still Get Sued?

The relationship between celebrities and paparazzi is notoriously contentious, from Sean Penn to Alec Baldwin to Halle Berry, it seems as though every A-lister has had a public run-in with the paps. And one only needs to remember the worst case scenario, the tragic death of Princess Diana, after paparazzi pursued the car she was in, leading to a fatal crash in Paris 20 years ago this month. A day doesn’t go by where celebs are pursued and someone is put in danger as a result of this kind of pursuit, and pop star Justin Bieber made headlines recently when the pickup truck he was driving accidentally clipped the leg of a photographer who, according to eyewitness accounts, would not leave Bieber alone.

Bieber was leaving a church worship service on Wilshire Boulevard in Beverly Hills this past July when the incident occurred. It appears that, despite his truck being flanked on all sides by paparazzi, Bieber did all the right things to exit the scene safely in his car, but his front right side tire hit a photographer who was pursuing him. After the incident, Bieber stayed with the photographer until police arrived. A statement from the Beverly Hills Police said “We arrived on scene and found a 57-year-old pedestrian on the ground. He was transferred to local hospital with non-life-threatening injuries. Justin Bieber remained on scene, co-operated with officers and was released.” The paparazzo himself also released a statement saying “He was compassionate; he’s a good kid. Accidents happen.”

Bieber has not been charged with anything (and neither has the pap who arguably, could have been, as he was preventing Bieber from driving) but the question that remains is whether the injured photog will file a civil suit seeking money damages. In California, the statute of limitations for car accident claims is two years. This means that the photog has 2 years from the date of the accident to file a lawsuit against Bieber with the court. We don’t generally say this at PROOF but given the pap’s comments noted above and the relatively minor injuries he seemed to have suffered in the accident, we don’t think Bieber is getting sued on this one. And, if the pap is already back on the street seeking that next celeb snapshot and does choose to file, it’s going to be pretty hard for his lawyers to prove he was injured in such a way as to deserve compensation.  Want to read more about lawsuits and Bieber? 3 Nasty Celebrity Neighbor Disputes

  1. Minnie Driver. Poor Minnie, only in her new house a few months when her neighbors, the Perelmutters, start complaining about use of a shared driveway (usage that had already been resolved in a 2008 lawsuit in which they were involved). The Perelmutters are alleging that Minnie has thrown baby food jars full of black paint at their house, has prevented access to parts of their home, has hurled expletives at them and, according to an Amended Complaint filed August 2, 2016, are suing her for assault, trespass, private, nuisance and intentional infliction of emotional distress. Minnie obtained a temporary restraining order against Perelmutter in Spring 2016 based on allegations that he blew smoke in her son’s face and cursed at them. And, in September 2016, filed a cross complaint against the Perelmutters. This one is going to stay pretty ugly. 
    Update: A judge agreed with Minnie Driver and on January 18, 2017, Perelmutter was ordered to knock down the wall he built as well as perform 10 days of community service. Perelmutter has until April 2017 to comply; if he doesn’t, he’s off to jail.

  2. Justin Bieber. Living near the “Sorry” star in theory, sounds like it would be pretty fun but ,most know now that reality of being the Biebs’ neighbor is less than well, neighborly. Kristen Bell and Dax Shepherd compared living next to him like “living in Lebanon” and former NFL wide receiver Keyshawn Johnson called the 19-year-old “entitled,” as he described how Bieber speeds up and down the street, and spits on people in the neighborhood. Finally, in 2015 some neighbors did something about it. Jeffrey and Suzanne Schwartz have sued Bieber and his bodyguards for harassing them and their family, vandalizing their house with eggs and threatening them with anti-Semitic remarks. A trial date has not yet been set.

  3. Ashley Greene. Though she seems to have won the hearts of many as Edward Cullen’s sister, Alice, in Twilight, this Hollywood star is not so beloved by her neighbors or doorman at her former West Hollywood apartment. She was sued by them as a result of a fire allegedly caused by a candle she left lit in the apartment in March 2013. The neighbors specifically alleged negligence, emotional distress, nuisance, breach of contract, and trespass and the doorman claimed he sustained injuries while helping tenants escape the burning building. The tenants also said Ashley never apologized for the starting the fire—not a legally actionable claim but an apology may have gone a long way with some of them. The fire was accidental and one of Ashley’s dogs perished in it. In late 2015, Ashley (or more likely, her insurance company) settled the claim for a confidential amount and the entire case was dismissed with prejudice.

From Shailene Woodley to Justin Bieber: The Best of Celebrity Mug Shots

From bar bust ups to drunk driving to “unintentional” trespassing and more, celebrities are no strangers to arrests. And of course with an arrest comes the dreaded celebrity mug shot, which is sure to be plastered across the Internet even before the celeb has called his lawyer!

Celebrity mug shots might just be our favorite form of selfie– well, it’s not really as selfie but we sure do like looking at them (Must be because without make up, the right lighting, a professional photographer and some retouching most celebs look a lot more like we do than we thought!).

Check out some of the celebrity mug shots of Hollywood hottest stars, and even a few of those  forgotten about players who just happen to have a celebrity mug shot worth talking about!

Shailene Woodley

Reese Witherspoon isn’t the only “Big Little Lies” cast member to have her celebrity mug shot taken. “Divergent” star Shailene Woodley also had a run in with the law. And though we might be biased because we absolutely love Shailene Woodley, we have to say  that out of all the celebrity mug shots, Woodley’s is pretty much the most adorable!

So, how’d she get to be part of the celebrity mug shot walk of fame? On October 10, 2016, Woodley and 27 other people were arrested during a protest at Standing Rock, while attempting to block the Dakota Access pipeline. Live footage of the actress’ arrest was streamed to roughly 40,000 viewers via her Facebook page. Later, she was strip searched in jail. I know, it seems weird to strip search someone following this type of offense and though kinda gross one can likely conclude that it might be related to her celebrity status (imagine those bragging rights?!) but despite Woodley also being “just shocked” by the strip search, apparently is is common practice in that jurisdiction for low level crimes.  Standing Rock Sioux Tribal Chair Dave Archambault II and others have also been strip-searched after being arrested for nonviolent civil disobedience against the pipeline.

After the arrest and resulting strip search, the environmental activist said: “Every time we allow another pipeline … we are endorsing the fossil fuel industry and only prolonging the time it is going to take to switch to renewable energy.”

We at PROOF aren’t fans of breaking the law but Woodley’s cause was a noble and good one.  We commend her for her bravery and standing up for what she believes in–no matter the consequences.  Keep fighting the good fight, Shailene!

Reese Witherspoon

The “Big Little Lies” actress and her husband, Jim Toth, were arrested in Atlanta in 2013. Toth was pulled over for suspicion of driving while intoxicated in Atlanta. Apparently Reese didn’t like that so much. So much so that she got into an argument with the police officer, which led to her arrest.

This celebrity mug shot is pretty unusual because it’s a pretty unusual mug shot for anyone — Witherspoon is looking down! The whole point of mug shots are for identification purposes. We have to wonder if the Atlanta PD gave the superstar a pass on looking at the camera because of her A-list status.

Either way, shortly after her jail release, the actress issued a statement saying there was “no excuse” for her behavior.

“I was disrespectful to the officer who was just doing his job. The words I used that night definitely do not reflect who I am. I have nothing but respect for the police and I am very sorry for my behavior.”

Nick Carter

Backstreet Boy Nick Carter may not have wanted it that way (sorry, sometimes we just can’t help ourselves with these puns!!) when he was arrested in Florida on January 13, 2016. The boybander was booked by the Monroe County Sheriff’s Office on a misdemeanor battery charge following an incident outside Hog’s Breath Saloon in Key West.

The singer was released after pleading not guilty and posting $1,500 bail. He was ordered to stay away from the bar.

Unfortunately for Carter, an employee at the Hog’s Breath, Skylar Carden, 21, filed a civil lawsuit against Carter a few weeks later, in which he accused the singer and former “Dancing with the Stars” runner-up of battery.

In a statement accompanying the lawsuit, Carter’s lawyer, Mark DiCowden’s said, “Nick Carter has shown the world that he is nothing more than a backstreet thug.” And you thought our pun was bad? Nick Carter,a thug? And what’s a backstreet thug?? All we picture is a good looking boy band member singing romantic songs. That’s not so scary! But the lawsuit did contain some scary allegations including that the singer “violently attacked” Carden by “striking and choking” him.

Carter settled the matter out of court–the terms of the settlement are not public–and the case was dismissed with prejudice (remember this means Carden can’t bring the suit again for any reason).

 

Pawn Stars Austin “Chumlee” Russell

Austin “Chumlee” Russell, star of the History Channel’s “Pawn Stars” was arrested in Las Vegas on March 10, 2016 and charged with drug possession and “prohibited person in possession of a firearm,” according to the Las Vegas Metro Police Department.

Here’s the really crazy part of this story: officers were serving a warrant at the reality star’s house for a sexual assault case when they found Russell with at least one gun, as well as with methamphetamine and marijuana.

In May 2016, Russell pleaded guilty in Las Vegas court to attempted possession of a controlled substance. As a result of the deal, Russell did not have to go to jail for the misdemeanor charge, instead he was sentenced to three years’ probation. The felony count of ownership or possession of a firearm by a prohibited person was stayed. If Russell completes the terms of his probation, the gun charge will be dismissed. And, that sexual assault charge that started the whole thing? Police have confirmed that Russell has not been charged at the time for that.

Bill Cosby

We know we talk about Bill Cosby a lot on PROOF but we can’t help it, there are just so many aspects of his wrongdoing that make for excellent legal lessons!  And so, Bill Cosby’s infamous celebrity mug shot, which was years in the making after dozens upon dozens of accusations. As PROOF readers know, there is only one criminal case going forward against the disgraced funny man. He has been free on $1 million bail, but faces up to 10 years in jail for each of the sexual assault counts he is facing.

The Montgomery County District Attorney’s office in Pennsylvania, where he is set to stand trial, released this mugshot shortly after his arraignment. Those do not look like the same kindly eyes of Dr. Huxtable. Unbelievable downfall.

Shia Labeouf

Shia Labeouf has been arrested more than once but of course his most famous celebrity mug shot was after getting drunk at Broadway musical “Cabaret” in New York City. In this shot, Labeouf has a big smile on his face and looks like he’s been crying. It’s unnerving to say the least!

According to police, the “Transformers” star was smoking inside the Studio 54 theater and acting “loud and disruptive” during the first act of the musical. Law enforcement officials were notified. The “Transformers” actor was arrested during intermission, handcuffed, and escorted out of the theater.

He was then charged with two counts of disorderly conduct and one count of criminal trespassing before being released.

Shia has since been arrested again in connection with his HeWillNotDivide.US protest but was also quickly released. For more information on that, click here.

Dustin Diamond

We all loved super nerd Screech on Saved by the Bell, too bad that geeky kid turned out to be such a not-so-great adult. Dustin Diamond gave off some seriously dangerous vibes when he made his way into the celebrity mug shots wall of fame after he was arrested in Wisconsin for allegedly stabbing a man with a switchblade on Christmas Day 2014.

The former teen actor was charged with possession of a switchblade, reckless endangerment and carrying a concealed weapon.

He was later convicted of carrying a concealed weapon and disorderly conduct, both misdemeanors. He served nearly three months in jail.

Lindsay Lohan

We love this one of Lindsay Lohan’s celebrity mug shots because she’s just so over it. She’s like — been there, done that!

This is the redhead’s mugshot from March 19, 2013 when she turned herself into the Santa Monica police. She eventually pleaded no contest to reckless driving and providing false information to the police who were investigating an accident that happened the previous summer.

Oh, Justin! We love you but you make it so hard on us sometimes.  What do we at PROOF have to say about our favorite bad boy’s celebrity mug shot? Well, does is not look like Bieber is having the best day of his life? Does to us! In reality though he has just been arrested for a DUI and drag-racing in Miami in 2014. Must have been a really fun race!

On the serious side though, at a press conference, a spokesperson for Miami Beach Police said that the arresting officer “smelled odor of alcoholic beverage” on the singer. Bieber was also charged with driving with an expired license and resisting arrest without violence.

We at PROOF are crossing our fingers and hoping that there are no celebrity mug shots of Bieber–even if they do look as good as this one!
